Terms of Service

These Terms of Service (“Terms”) govern your access to collinspainting.ca (the “Website”) and any residential or commercial painting, surface-preparation, or finishing work (collectively, the “Services”) supplied by Collins Painting (“Company,” “we,” “our,” or “us”), headquartered in Windsor, Ontario, Canada. BY VISITING THE WEBSITE, REQUESTING AN ESTIMATE, PLACING AN ORDER, OR CONSENTING TO RECEIVE ELECTRONIC COMMUNICATIONS,

YOU AGREE TO BE BOUND BY THESE TERMS

1. Services Provided


We provide interior and exterior painting for residential, commercial, and light-industrial properties, including but not limited to: surface cleaning, sanding, priming, repairing minor drywall or wood imperfections, applying paint, stain, or protective coatings, and final touch-ups. All work is performed by trained employees or subcontractors who meet our safety and quality standards.




2. Estimates & Agreements


Written Scope. Every project begins with a written estimate describing areas, surface conditions, products, colours, start date, and projected completion.Non-Binding Until Signed. Estimates are non-binding until both parties sign a Customer Agreement.Change Orders. We may adjust price and timeline if we encounter hidden or changed conditions (e.g., moisture damage, mold, pest infestation, unsafe substrates, structural movement). Any change will be documented, costed, and approved in writing before work proceeds.




3. Payment Terms


Deposit. A 25 % deposit is due upon acceptance of the estimate.Progress Payments. Larger projects (over C$10 000 or two weeks’ duration) may require progress draws, each invoiced and payable within 7 days.Final Balance. The remaining balance is due upon substantial completion and your walkthrough approval.Late Payment. Overdue amounts bear interest at 2 % per month (26.8 % per annum) and may trigger suspension of work or collection action.Accepted Methods. We accept e-transfer, major credit cards, cheque, and cash.




4. Access & Customer Responsibilities


You agree to:

5. Limited Workmanship Warranty


We warrant our

labour for two (2) years

from the invoice date against peeling, blistering, or chipping caused by defective workmanship.

Exclusions:

Normal wear, fading, or damage from weather, moisture intrusion, structural movement, or inadequate ventilation.Failures where the underlying surface was previously compromised but not visible at the estimate.Coatings or materials supplied by you or any brand we expressly advised against.


Warranty claims must be submitted in writing within the warranty period; our sole obligation is to correct covered defects.




6. Cancellation Policy


You may cancel or reschedule up to

72 hours

before the agreed start date without charge. Later cancellations incur a fee equal to the reasonable mobilization and labour costs already committed (typically 10 %–15 % of the contract value).




7. Mobile & Electronic Communications


7.1 Express Consent


Commercial electronic messages (SMS, MMS, RCS, email, or voice) are

sent only after your clear, affirmative opt-in

—for example, checking a box on our web form, replying

, or signing a paper estimate referencing these Terms.


7.2 Opt-In Disclosures


Every call-to-action includes: the program name (“Collins Painting Updates”), our legal name and address,

“Msg & data rates may apply,”

message frequency (“up to 4 msgs/month” for promotions; job-status alerts up to one per workday), links to these Terms and our Privacy Policy, and a statement that consent is

not

a condition of purchase.


7.3 Opt-Out / Help

for assistance. A confirmation of your opt-out is the final message you’ll receive.


7.4 Carrier & Delivery Disclaimer


Wireless carriers

do not guarantee message delivery and are not liable for delayed or undelivered messages

7.5 Message Frequency & Rates


“Message frequency varies” and depends on project activity and your marketing preferences. Standard text-message charges from your carrier apply.


7.6 Record-Keeping


We log the phone number/email, opt-in method, timestamp, IP address (for web forms), and any relevant screenshots for

at least three (3) years

to demonstrate compliance.


7.7 No List Rental or Sale


Opt-in data and consent are

never sold or rented

to third parties; sharing is limited to service providers strictly for delivering our messages.


7.8 Canadian Anti-Spam Legislation


For Canadian recipients, every electronic message is a “Commercial Electronic Message” under CASL. We therefore:


Obtain express consent unless an exemption applies (e.g., quote you requested);Clearly identify ourselves and provide contact data; andInclude a working unsubscribe link or keyword, functional for at least 60 days.




8. Privacy


Our separate Privacy Policy explains what personal information we collect, how we safeguard it, and your rights of access or correction.




9. Website Content & Acceptable Use


The Website’s content is provided “as-is” for general information. We strive for accuracy but do not guarantee completeness or suitability. You may not scrape, copy, or republish any text, images, or code without written permission; nor may you use the Website to transmit unlawful, harmful, or unsolicited content or to harvest email addresses or phone numbers.




10. Limitation of Liability


To the fullest extent allowed by law,

Collins Painting is not liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue

, arising from your use of our Services or Website. Our aggregate liability for any claim is limited to the amount you paid for the specific Service giving rise to the claim.




11. Indemnification


You agree to indemnify and hold harmless Collins Painting, its owners, employees, and subcontractors from any claims, damages, or expenses arising out of: (a) your breach of these Terms; (b) your negligent or wrongful acts; or (c) your failure to secure the work site as required in § 4.




12. Governing Law & Venue


These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. The courts of Windsor, Ontario have exclusive jurisdiction over any dispute.




13. Changes to These Terms


We may amend these Terms at any time. Changes take effect when posted on this page with an updated “Effective Date.” Continued use of the Website, Services, or failure to opt-out of messaging after notice constitutes acceptance.
