COLLINS PAINTING – PAINT PERFORMANCE GUARANTEE

1. WARRANTY COVERAGE

Collins Painting (“the Contractor”) warrants that all paint coatings applied by its professional team shall remain free from peeling, blistering, or flaking for the period of time specified in the original written agreement (“Warranty Period”), provided that all maintenance and environmental conditions outlined herein are satisfied.

This warranty commences on the date the project is paid in full.

No warranty of any kind shall apply to projects that are only partially paid.

This warranty shall be null and void if the final invoice is not paid in full within thirty (30) days of job completion.

The Warranty Period is based on optimal surface conditions. Other painted surfaces, including previously coated, weathered, or non-standard substrates, may have reduced warranty periods as determined by the paint manufacturer’s recommendations.

This warranty applies only to vertical surfaces. Horizontal or downward-facing surfaces (including, but not limited to, window sills, decks, handrails, and floor surfaces) are expressly excluded from coverage.


2. PAINT COVERAGE CONDITIONS

This warranty applies only where Collins Painting supplied all paint materials as part of the original contract and invoice. Paint coverage shall extend solely to materials provided, selected, and purchased by Collins Painting.

This warranty expressly excludes:

Any paint or coating products supplied by the customer or a third party;

Any paint materials not purchased and provided directly by Collins Painting;

Any project where the customer elected to supply their own paint, in whole or in part.


3. LABOR AND MATERIAL COVERAGE

In the event of a verified paint failure covered under this guarantee, Collins Painting shall, at its sole and exclusive discretion, either:

Perform the necessary repair work at no cost to the customer, including both labor and materials, limited to the affected areas as determined by inspection; or

Provide a cash payment equivalent to the reasonable cost of such repair, up to the maximum liability outlined in Section 4.

Repairs under this guarantee shall be performed only once per affected area (for example, a specific wall, door, or section). Subsequent failures in the same area after the initial repair shall not be covered under this warranty.


4. MAXIMUM LIABILITY

Collins Painting’s maximum total liability under this guarantee shall not exceed the total original contract amount paid for the project, inclusive of all labor and materials.

Under no circumstances shall Collins Painting be liable for consequential, incidental, indirect, or special damages, including but not limited to loss of use, diminution in property value, or damage beyond the painted areas.


5. CLAIM PROCESS AND INSPECTION

Notice of Claim:
The customer must submit written notice of claim to Collins Painting within thirty (30) days of discovering the alleged paint failure.

Inspection:
Upon receipt of a claim, Collins Painting shall perform an on-site inspection within fourteen (14) business days to assess and document the claim. Collins Painting reserves the right to photograph, record, and otherwise document the conditions observed.

Paint Manufacturer Review:
Collins Painting may, at its discretion, request that the paint manufacturer or supplier inspect or review the affected surfaces.
If the paint manufacturer determines that the condition or deterioration is not covered under its own product warranty for any reason whatsoever, Collins Painting shall have no obligation to perform repairs or provide compensation of any kind under this warranty.

Final Determination:
Collins Painting shall have the sole and final authority to determine:

Whether the claim is valid;

The scope of any warranted repair or payment; and

The interpretation and application of all terms of this warranty.
Such determination shall be final, binding, and conclusive.

Repair or Payment:
Based on inspection findings and, where applicable, manufacturer input, Collins Painting shall determine whether to perform repairs or provide payment in lieu of repair.


6. REPAIR METHOD AND SCOPE

Repair Discretion: Collins Painting reserves the right to perform spot repairs limited to affected areas rather than full-surface repainting, provided such repairs restore paint performance to acceptable industry standards.

Subcontracting: Collins Painting expressly reserves the right to engage qualified subcontractors to perform any or all warranty-related work.

Standard of Repair: All repair work shall be performed in a professional manner consistent with recognized trade practices.


7. SEASONAL AND WEATHER CONSIDERATIONS

Due to the nature of exterior painting and weather-related constraints, Collins Painting shall schedule warranty repairs during periods of suitable weather conditions. Seasonal demand, temperature, and humidity may extend repair timelines. Collins Painting will make reasonable efforts to complete repairs in a timely manner.


8. MAINTENANCE REQUIREMENTS

This warranty remains valid only if:

All original surface preparation was completed by Collins Painting;

The customer has maintained painted surfaces in accordance with standard care practices;

The property has not suffered from water intrusion, structural movement, or other external factors affecting paint adhesion;

The customer has not altered, modified, coated, power washed, or otherwise treated the painted surface in a manner that could affect paint adhesion or appearance.

Power washing, scrubbing, or otherwise cleaning the painted surface within three (3) months of project completion will immediately void this warranty.

Excessive power washing, chemical cleaning, sanding, recoating, or application of sealants or other coatings will also void this warranty.

Failure to maintain gutters, roofing, flashing, or other structural elements that lead to moisture damage shall void this warranty.


9. EXCLUSIONS

This warranty does not cover:

Paint failure due to customer-supplied or improperly stored materials;

Damage from structural movement, water infiltration, or vapor transmission;

Fading, color change, or gloss loss due to sunlight, aging, or environmental exposure;

Normal wear and tear, or natural aging and deterioration unrelated to peeling, blistering, or flaking;

Any condition determined by Collins Painting or the paint manufacturer to be consistent with normal aging or expected product performance;

Any surface, coating, or paint that is beyond the paint manufacturer’s warranty period for any reason whatsoever, including but not limited to time expiration, environmental exposure, or product limitations;

Impact, abrasion, or chemical damage;

Paint applied to surfaces not prepared or primed by Collins Painting;

Any surface previously repaired under this warranty;

Any area modified, refinished, or recoated by the customer or a third party after project completion.


10. NON-TRANSFERABILITY

This warranty is non-transferable and applies only to the original customer and the property owner named in the original written agreement. Any sale, transfer, or conveyance of the property automatically terminates this warranty in its entirety.
